1. Introduction

Welcome to Swanweby (“we,” “our,” “us”). These Terms and Conditions (“Terms”) govern your access to and use of the Swanweby platform and services. By subscribing to our services, you agree to be bound by these Terms. If you do not agree, please do not use our services.

2. Services Provided

Swanweby provides fully managed websites and business automation tools, including but not limited to: website creation, AI chat tools, booking automations, review request workflows, and more.

3. Subscription Plans & Minimum Commitments

We offer the following plans:

• Essential Website Plan

$149/month with a one-time $297 setup fee

3-month minimum commitment

Early cancellation will incur charges equal to the remaining balance of the initial 3-month term

• Smart Business Plan (SwanAssist AI Suite)

$297/month with no setup fee

6-month minimum commitment

Early cancellation will incur charges equal to the remaining balance of the 6-month term

After the initial term, all plans convert to month-to-month and may be cancelled at any time with no further obligation.

4. Setup Fees & Refund Policy

Setup fees (e.g., $297 for the Essential Plan) are non-refundable, as they cover labor and technical preparation completed at the beginning of your subscription.

Subscription payments are also non-refundable, unless otherwise stated in writing.

5. Cancellation Policy

To cancel, you must send written notice (email) to [email protected] at least 3 business days before your next billing date.

If you cancel before your minimum commitment is completed, you agree to pay the remaining balance for that commitment period.

6. Website Ownership & Buy-Out Option

All websites are built and hosted on the Swanweby platform, a proprietary system designed for speed, automation, and ease of use. While you do not receive access to the backend infrastructure or system code, you fully own all content you provide to us — including your business name, branding, text, images, and other media.

If you cancel your subscription, your website and platform access will be deactivated at the end of your billing cycle. However, we offer a Buy-Out Option for clients who wish to take their content and recreate the site on another platform.

The Buy-Out includes:

• A structured document with all website copy (text from each page)

• A folder of all images and media assets used on your site

• A page-by-page outline of your website’s layout and sections

• A list of forms, lead capture questions, and key functionality

This Buy-Out is a manual export provided for a one-time fee of $500–$800, depending on website complexity.

Please note: this export does not include the original platform’s functionality, automations, AI assistant, chat tools, or system design, which are exclusive to the Swanweby platform.

7. Acceptable Use

You agree not to use the platform for any illegal, fraudulent, or harmful purposes. We reserve the right to suspend or terminate your account for any violations.

8. Limitation of Liability

To the fullest extent permitted by law, Swanweby is not liable for any indirect, incidental, or consequential damages resulting from the use or inability to use our services.

Total liability is limited to the amount paid in the last 3 months of active subscription.

9. Governing Law

These Terms are governed by the laws of the Province of Quebec, Canada. Any disputes shall be resolved in the courts of Montreal, Quebec.
